Moonra — Terms of Use & Sale
Welcome to Moonra.
These Terms of Use & Sale (the "Terms") set out the rules for using the Moonra website (the "Site") and for buying the products and using any related services, tools, features, or content offered through it. In this document, "Moonra," "we," "us," and "our" refer to the business that runs the Moonra online store, and "you" and "your" refer to anyone who visits, shops, buys, or otherwise uses the Site.
Our store runs on Shopify's platform, which supplies the technology and infrastructure that lets us offer and sell online. These Terms work alongside any policies expressly built into them — including our Privacy Policy, Refund & Returns Policy, Shipping Policy, and any promotion-specific conditions shown at the time of purchase. By using the Site or placing an order, you agree to be bound by them.
1. Who Can Use the Site
The Site is meant for lawful, personal use. By using it or placing an order, you confirm that you're at least 18 (or otherwise have the legal capacity to enter a binding agreement where you live). You shouldn't place an order if you don't agree to these Terms, lack the capacity to agree, or are barred by law from using the Site or buying our products.
If you let a minor in your care use the Site through a device or account you control, you remain responsible for that use to the extent the law allows. When we ask you for information — at checkout or when registering an account — you agree to give us details that are accurate, complete, and reasonably up to date. You're responsible for keeping your login details confidential and for what happens through your account, and you may not sell, rent, transfer, or otherwise hand your account to someone else for unauthorised use. We may limit, suspend, or end access where we reasonably believe the Site is being misused, compromised, or used against these Terms.
2. Our Products
Moonra offers consumer products — principally natural-stone bracelets and related jewelry or accessories we may add over time. We make a genuine effort to show our products accurately through descriptions, photos, videos, and other material on the Site.
That said, because our bracelets are made from genuine natural stones, each piece is one of a kind. The exact colour, pattern, veining, markings, size, and finish of the beads will vary naturally from stone to stone and from one bracelet to the next, and the appearance on screen can shift depending on lighting, photography, screen calibration, and your device's settings. Minor differences in colour, pattern, texture, dimensions, or packaging are part of the character of natural stone and don't, on their own, mean a product is faulty.
We may improve, change, replace, or discontinue products at any time, update versions or packaging, adjust specifications, limit quantities or where products are available, temporarily pull items from sale, or retire them entirely. Seeing a product on the Site doesn't guarantee it will stay available.
3. Product Information and Intended Use
Our product descriptions are there to help you understand the general nature of each piece and how it's meant to be used. Choosing the products, sizes, and styles that suit you is your call.
Unless we clearly say otherwise, Moonra products are ordinary consumer jewelry. They are not medical devices and are not intended to diagnose, treat, cure, prevent, or manage any disease, injury, or medical or psychological condition. They are not a substitute for professional medical, financial, or other advice, nor for any treatment, medication, or professional service.
Moonra draws on crystal traditions, intention-setting, and ritual, which are cultural and spiritual practices rather than scientifically proven methods. Any references to abundance, prosperity, opportunity, grounding, calm, confidence, or similar themes describe these traditional associations and the intended spirit of the product — they are not promises or guarantees of any particular financial, personal, emotional, or other result. Experiences are personal and differ from one individual to the next. Nothing we say about our products should be taken as a guarantee that wearing them will produce a specific outcome.
4. Orders and Acceptance
Products shown on the Site are an invitation for you to place an order, not a binding offer by us, and adding something to your cart doesn't reserve it. When you submit an order you're making an offer to buy the selected items at the total shown at checkout. An automated order confirmation doesn't necessarily mean we've finally accepted the order.
We may review orders before fulfilment for legitimate reasons — payment authorisation, suspected fraud, stock availability, pricing errors, unusual quantities, shipping restrictions, incorrect details, suspected resale, or other operational or security concerns — and we reserve the right to accept, decline, limit, or cancel an order where reasonably necessary and legally permitted. If we've already taken payment for an order we then cancel, we'll refund the relevant amount to the appropriate payment method.
5. Checking Your Order
Before you submit an order, it's on you to review it carefully — the products, size, quantity, delivery address, billing details, email address, payment information, and any promo code. Please make sure everything entered at checkout is complete and correct. Once an order moves into processing or fulfilment, changes or cancellation may no longer be possible, and where we can accommodate a change, it depends on operational availability and isn't guaranteed.
Unless we've authorised it, purchases are meant for personal or household use, and we may limit or cancel orders that reasonably look like they're mainly for unauthorised resale, redistribution, or commercial export.
6. Pricing
Prices on the Site can change at any point before you submit an order. The price that applies to your purchase is generally the one shown at checkout when you place it, subject to us correcting obvious or material errors. Depending on where you are, your total may include or exclude sales tax, VAT or similar taxes, shipping, handling, customs duties, import charges, or other government fees. Charges we collect directly are generally shown at checkout; customs duties, import taxes, brokerage fees, and similar charges that we don't collect remain your responsibility unless we expressly say otherwise.
7. Promotions and Discount Codes
From time to time Moonra may run discounts, bundles, promotional pricing, free-product offers, seasonal campaigns, or codes. Each promotion may carry its own conditions — start and end dates, product exclusions, regional limits, minimum spends, maximum quantities, eligibility requirements, single-use limits, or rules on combining offers. Unless we say otherwise, codes and discounts have no cash value and offers can't be stacked unless the Site specifically allows it.
We may refuse or cancel promotional use that reasonably looks like fraud, automation, duplication, manipulation, abuse, or anything contrary to the point of the promotion, and where an offer is hit by a material technical, pricing, or configuration error, we reserve the right to correct or withdraw it where the law allows. If a promotion's specific terms conflict with these general Terms, the specific terms win for that promotion.
8. Payment
Orders have to be paid using one of the methods offered at checkout. By submitting payment details, you confirm that the information is accurate, that you're authorised to use the method, that you authorise the charge, and that there's sufficient authorisation or funds to complete it.
Payments may run through third-party providers. Moonra doesn't control every decision made by banks, card issuers, payment networks, processors, or fraud-prevention services, so a transaction may be declined, delayed, held, or reviewed by a third party outside our control. We're not responsible for fees your bank, card issuer, payment provider, or currency-conversion provider charges independently.
9. Shipping
Available shipping methods and estimated delivery details may appear on the Site or at checkout. Unless we clearly state otherwise, shipping and delivery timeframes are estimates, not guaranteed dates. Delivery can be affected by things beyond our reasonable control — carrier delays, weather, customs inspections and clearance, public holidays, transport disruptions, local delivery conditions, incorrect addresses, unusually high volume, and similar events. We'll make reasonable efforts to process and dispatch orders in line with the information on the Site, and a delay doesn't automatically entitle you to compensation except where the law or our published policies require it.
10. Delivery and Tracking
Providing a complete, accurate, deliverable address is your responsibility. If delivery can't be completed because the details you gave are wrong, incomplete, inaccessible, or otherwise unsuitable, extra handling or reshipping charges may apply where the law permits. Tracking is provided once it's available from the carrier. Carrier tracking runs independently of Moonra and may occasionally show delayed, premature, incomplete, or inaccurate scans. If you think a package is missing, materially delayed, damaged, delivered to the wrong place, or otherwise affected by a shipping problem, contact us as soon as you reasonably can so we can look into it.
11. Returns, Refunds, and Exchanges
Returns, refunds, replacements, and exchanges are governed by the Moonra Refund & Returns Policy on the Site, which forms part of these Terms. Please follow the instructions and eligibility requirements in that policy when making a request. Nothing in these Terms removes any consumer right that can't legally be waived, and where mandatory consumer-protection law gives you rights beyond our standard policies, those rights still apply.
12. Intellectual Property
The Moonra Site and the materials on it are owned by, licensed to, or otherwise lawfully used by Moonra and the relevant rights holders. Protected materials may include the Moonra name, trademarks, logos, slogans, product names, designs, photography, videos, graphics, illustrations, advertising creative, written copy, product descriptions, packaging, icons, website layouts, and other original content — protected by copyright, trademark, trade-dress, design, unfair-competition, and other laws. Using the Site or buying a product doesn't transfer any of these rights to you, and all rights not expressly granted are reserved.
13. Using Moonra Content
You can view Moonra content for ordinary personal, non-commercial shopping. Without our prior written permission, you may not commercially copy our product photography, reproduce our videos, republish substantial parts of our written content, duplicate product pages, reproduce our advertising, copy our packaging or branding, create confusingly similar branding or storefronts, distribute unauthorised copies of our materials, falsely imply you're affiliated with us, remove IP notices, or otherwise commercially exploit our content. Content being publicly visible on the Site doesn't grant any implied licence to use it commercially.
14. Reviews, Feedback, and Submissions
You may have chances to send us reviews, testimonials, comments, photos, videos, suggestions, feedback, or questions. You keep whatever ownership rights you already hold in what you submit, but by sending it to us voluntarily you grant Moonra a worldwide, non-exclusive, transferable, sublicensable, royalty-free licence to use, reproduce, adapt, format, publish, distribute, display, communicate, and promote that material for legitimate business purposes — including marketing, advertising, customer communication, and product improvement. Where the law allows, this licence may continue after you stop using the Site.
By submitting content, you confirm that you have the right to provide it, that it doesn't unlawfully infringe anyone's rights, that any review presented as personal experience reflects a genuine experience, that it doesn't knowingly contain materially false or misleading information, that it contains no malicious software or unlawful material, and that any legally required disclosure about compensation, incentives, or material relationships has been made. We may review, moderate, refuse, edit, or remove submissions where reasonably appropriate, and we're not obliged to publish every review we receive.
15. Things You Must Not Do
You may use the Site only for lawful purposes. You must not use or try to use it to commit fraud, carry out unlawful transactions, use stolen payment credentials, impersonate another person or organisation, infringe IP rights, spread malware, attack or interfere with our systems, gain unauthorised access to accounts or systems, bypass security controls, interfere with checkout, unlawfully harvest personal information, send spam, harass or threaten anyone, manipulate promotions, interfere with other customers' use of the Site, or do anything the law prohibits. We may put reasonable technical, security, or operational measures in place to protect Moonra, our customers, our providers, and the Site against fraud, scraping, automated misuse, cyberattacks, and other abuse.
16. Automated Access
We may restrict automated access that could interfere with the Site's performance, security, IP rights, customer privacy, or legitimate operations. Unless we've authorised it, you may not use bots, crawlers, scrapers, autonomous agents, extraction software, or similar systems to systematically collect, reproduce, monitor, or commercially exploit information from the Site, and you may not bypass CAPTCHAs, rate limits, access controls, authentication, anti-bot systems, or other technical protections. We may restrict automated traffic we reasonably judge to threaten the integrity or operation of the Site.
17. Third-Party Services
The Site may use or link to services run by third parties — covering things like ecommerce infrastructure, payments, fraud prevention, analytics, advertising, support, order tracking, fulfilment, shipping, or communications. These may have their own terms and privacy policies, and Moonra doesn't necessarily own, operate, supervise, or control them. We're not responsible for third-party websites, products, content, or services just because they're linked to or integrated with the Site.
18. Shopify
The Moonra store uses Shopify technology, which provides the ecommerce infrastructure that lets us run the Site and sell online. Products bought from Moonra are sold by Moonra, not by Shopify. To the extent the law allows, Shopify isn't responsible for Moonra's obligations around the sale, fulfilment, quality, delivery, return, refund, or use of our products. Shopify may process information about your interaction with the Site as needed to provide its services; more on how personal information is handled is in our Privacy Policy and, where relevant, Shopify's own privacy documentation.
19. Privacy
How we collect, process, store, and use personal information is covered in the Moonra Privacy Policy. We may rely on service providers in different countries to run parts of our business — hosting, ecommerce infrastructure, payments, analytics, advertising, fulfilment, logistics, security, and customer service — so your information may be processed in places outside where you live, where the law permits. Please see our Privacy Policy for the detail.
20. Important Legal Notice
THIS DOCUMENT CONTAINS IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS, ALONG WITH CONDITIONS, LIMITATIONS, EXCLUSIONS, WARRANTY DISCLAIMERS, AND DISPUTE-RESOLUTION PROCEDURES THAT MAY APPLY TO YOU. PLEASE READ THESE TERMS CAREFULLY.
CERTAIN DISPUTES BETWEEN YOU AND MOONRA MAY HAVE TO BE RESOLVED THROUGH BINDING ARBITRATION ON AN INDIVIDUAL BASIS, RATHER THAN THROUGH A JURY TRIAL, CLASS ACTION, CLASS ARBITRATION, COLLECTIVE PROCEEDING, OR OTHER REPRESENTATIVE ACTION, UNLESS YOU VALIDLY OPT OUT OR APPLICABLE LAW PROVIDES OTHERWISE.
BY PLACING AN ORDER THROUGH THE MOONRA WEBSITE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THESE TERMS AND ANY POLICIES EXPRESSLY INCORPORATED INTO THEM.
You may not buy or obtain products through the Site if (a) you don't agree to these Terms, (b) you're under 18 or otherwise lack the legal capacity to enter a binding agreement, or (c) the law prohibits you from using the Site or buying what's offered through it. The arbitration provisions are described in more detail in the Dispute Resolution and Individual Arbitration section below.
21. Availability of the Site
We try to keep the Site up and running properly, but we can't guarantee uninterrupted access. It may become temporarily unavailable due to scheduled or emergency maintenance, infrastructure updates, software issues, provider outages, telecoms failures, security incidents, unusual demand, or events beyond our reasonable control. We may modify, update, suspend, replace, or discontinue features where reasonably necessary.
22. Errors and Corrections
We aim for accurate product, pricing, shipping, and promotional information, but errors can happen — in prices, discounts, promotions, descriptions, specifications, availability, shipping charges, delivery estimates, or other Site information. Where the law allows, we reserve the right to correct errors when we find them. If an error materially affects an order you've already placed, we may contact you, correct the information, cancel the order, issue a refund, or offer another appropriate remedy depending on the situation.
23. General Website Information
Information on the Site is there to help you and may change as our products and business evolve. While we make reasonable efforts to keep it useful and accurate, we don't guarantee that every piece of general informational content will always be complete, current, or error-free. What's actually binding for a specific transaction is set by the applicable order information, product details, promotional conditions, and policies in effect at the relevant time.
24. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE, ITS CONTENT, AND RELATED SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
Except for warranties Moonra expressly provides or rights that can't legally be excluded, we make no additional express or implied warranties about uninterrupted availability, error-free operation, compatibility with every device or system, continuous access, freedom from every technical defect, or suitability for purposes beyond those expressly described. To the fullest extent the law allows, implied warranties that might otherwise apply are excluded or limited to the maximum extent permitted. Nothing here limits a mandatory warranty, statutory guarantee, or consumer right that the law doesn't let us waive.
25. Limitation of Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful. Subject to that, and to the fullest extent the law allows, Moonra and its owners, affiliates, officers, directors, personnel, contractors, service providers, suppliers, agents, and licensors won't be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or relating to the Site, the services, or products bought through it — which may include, where legally permitted, lost profits, revenue, savings, business opportunities, or data, or other indirect economic loss. These limits apply whether a claim is framed in contract, negligence, tort, statute, strict liability, or any other theory. Where liability can't legally be excluded but can be limited, ours is limited to the maximum extent the law allows.
26. Responsibility for Your Conduct
To the extent the law allows, you agree to be responsible for losses, claims, liabilities, damages, and reasonable costs arising directly from your material breach of these Terms, any fraud you commit, unlawful use of the Site, infringement of someone else's rights, or malicious activity through your account. Where legally permitted and reasonably needed, you agree to cooperate with Moonra in responding to third-party claims arising from such conduct.
27. Suspension and Termination
We may restrict, suspend, or end your access where reasonably necessary — including where we believe you've materially broken these Terms, fraud has occurred, the Site's security is threatened, someone's rights are being infringed, there's been payment abuse, or continued access could expose Moonra, our customers, or third parties to legal, financial, operational, or security risk. Ending access doesn't erase obligations or liabilities that arose beforehand, and any provisions that by their nature should outlast termination — IP, payment obligations, submissions, liability limits, dispute resolution, arbitration, and other accrued rights — continue to apply.
28. Changes to These Terms
We may revise these Terms from time to time to reflect changes to the Site, new products or services, operational developments, new providers, security needs, changes in law, or changes in how we run things. The latest version will be posted on this page with its update date, and where the law requires, we'll communicate material changes by an appropriate method. Continuing to use the Site after revised Terms take effect means you accept them for future use. The version that applies to a completed purchase is generally the one in effect when that transaction happened, unless the law requires otherwise.
29. Severability
If a court, arbitrator, or other competent authority finds any provision invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent legally possible, and if needed the invalid part will be severed without affecting the rest. The remaining Terms stay in force.
30. No Waiver
If Moonra doesn't immediately exercise or enforce a right under these Terms, that's not a permanent waiver of it, and waiving one breach or situation doesn't automatically waive another.
31. Assignment
You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent, where that restriction is permitted by law. Moonra may assign or transfer its rights and obligations in connection with a corporate reorganisation, restructuring, merger, acquisition, asset sale, transfer of business, change of ownership, or similar transaction, subject to the law.
32. Dispute Resolution and Individual Arbitration
32.1 Agreement to Resolve Disputes Individually
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS HOW CERTAIN DISPUTES BETWEEN YOU AND MOONRA MAY BE RESOLVED. Except where the law prohibits it or you validly opt out as described below, you and Moonra agree that covered disputes will be resolved through binding individual arbitration rather than a lawsuit before a judge or jury. This arbitration agreement is meant to be read broadly. It covers, to the fullest extent the law allows, disputes or claims arising out of or relating to these Terms, your use of the Site, products offered or bought through it, orders, payments, promotions, advertising, communications, shipping, delivery, returns, refunds, privacy, customer service, or the relationship between you and Moonra — whether they arise under contract, tort, negligence, statute, regulation, fraud, misrepresentation, consumer law, or another theory.
32.2 Federal Arbitration Act
To the fullest extent legally applicable, this arbitration agreement and any questions about its interpretation, applicability, enforceability, or formation are governed by the U.S. Federal Arbitration Act ("FAA") rather than state arbitration laws. Using the FAA here doesn't remove any substantive legal right or consumer protection that can't lawfully be waived.
32.3 No Jury Trial
Where a dispute is subject to binding arbitration, both you and Moonra give up the right to have it decided by a judge or jury in court. An arbitrator, not a judge or jury, resolves it, subject to this agreement and applicable law.
32.4 Individual Claims Only
To the fullest extent the law allows, arbitration happens solely on an individual basis. You and Moonra agree not to bring covered claims through class actions, class arbitration, collective or representative proceedings, consolidated arbitration involving unrelated parties, or proceedings where one person seeks relief for others. The arbitrator may award relief only to the individual seeking it and only as far as needed to resolve that person's claim, except where the law requires otherwise.
32.5 Informal Resolution First
Before starting arbitration, the party raising a dispute should first make a reasonable attempt to sort it out informally. You can contact Moonra at support@mymoonra.com. Your notice should give us enough to understand the issue, including where reasonably applicable your name, the email tied to the order, the order number, a description of the problem, and the resolution you're seeking. Both sides agree to make reasonable good-faith efforts to resolve things before starting formal arbitration.
32.6 Arbitration Procedure
If a covered dispute can't be resolved informally, either party may begin binding arbitration under this section. It will be conducted by a neutral arbitrator in line with applicable arbitration procedures and law. The arbitrator can award any individual remedy that would otherwise be available under the law, subject to the limitations in these Terms to the extent they're enforceable, and the decision can be entered and enforced by a court with appropriate jurisdiction.
32.7 Arbitration Opt-Out
You can opt out of the arbitration provisions in this Section 32 by sending us written notice within 30 days of first becoming subject to these Terms. Your notice must clearly state that you want to opt out of Moonra's arbitration agreement and should include your full name, the email used for your Moonra account or order where applicable, and a clear statement that you're opting out. Send it to support@mymoonra.com. Validly opting out won't affect the rest of these Terms and won't affect your ability to buy from or use Moonra.
32.8 Rights That Cannot Be Waived
Nothing in this arbitration section is meant to remove, restrict, or waive any substantive consumer right, statutory protection, remedy, or procedural right that can't legally be waived or forced into arbitration. If the law gives you a non-waivable right to pursue a particular claim in court or before a government or regulatory body, that right is unaffected.
32.9 Severability of Arbitration Terms
If part of this arbitration agreement is found invalid or unenforceable, that part will be severed or limited to the minimum necessary while the rest continues where legally permitted. However, if the prohibition on class or representative arbitration is found unenforceable for a particular claim in a way that would allow class-wide arbitration, then the agreement to arbitrate that particular class or representative claim won't apply unless the parties agree otherwise.
33. Entire Agreement
These Terms, together with the policies and conditions expressly incorporated into them, make up the agreement between you and Moonra about using the Site and buying through it. They replace prior communications or understandings on the same subject to the extent the law allows. Nothing here excludes any representation, obligation, or consumer right the law doesn't let us exclude.
34. Headings
Section titles are for convenience and readability only. They don't change, limit, expand, or otherwise affect how these Terms are interpreted.
